Adverse Action Procedure

The District will ensure every applicant who wishes to work or volunteer for the District has a fair and equitable opportunity to do so. The applicant will be sent a pre-adverse letter and a copy of their report by the District  Included in the communication from the TPA will be instructions on how to contact the District to dispute the report. After notice to the applicant, the District will wait seven calendar days before taking any adverse action in order to give the applicant an opportunity to refute the information. If the applicant does not dispute the information contained in the background check results, the applicant will be sent a final adverse letter, which will contain, at a minimum, the following: 
 
  • Name, address, and phone number of the District;
  • A statement that the vendor that supplied the report did not make the decision to take the adverse action and cannot give specific reasons for it;
  • A notice of the individual’s right to dispute the accuracy or completeness of any information the vendor furnished; and
  • The individual’s right to an additional free consumer report from the vendor upon request within 60 days.
 
The District will send the final adverse letter to the applicant within 7-10 business days.
Testimonials from family members, participants, community members, etc. will not be considered as part of the process described above.
